Well it looks like Olive wants to  play Dumb.
I have arrange to send  units to 3 reviewers, and a independent test lab.
The lab tests /measurements will be posted online with the reviewers comments.

Phil mentioned its Illegal to record a phone conversation in Ca.
Well it is not Illegal when you tell the other party numerous times, they was being recorded.

Not quite...the laws in California require consent, not just telling the other party... :rules:

You mean Olive provided you with consent??  That would be surprising.

This thread is just too fun.

As far as the "group buy", I didn't know that I had to adhere to a specific "protocol" to be a real group Surprised

I saw the products, became a dealer, wanted one for myself (which I couldn't afford) and organized a group buy.  Plain and simple.  I told OLIVE I was doing so, and communicated how it was going several times.
Thanks for the reply.  I'm also an Olive dealer but have been told under no circumstances can I sell for less than MSRP.  This company is bothering me as I also can not get my hands on the 180GB Musica's and insist I can only sell the 250GB units (which isn't bad, but they cost more).

How interesting that one dealer is told to sell at MSRP, and another is allowed to sell at 10 points over dealers cost, with drop shipping from the factory.

I called Olive and they said there was no  "group buy."

As to performance, they said all their units should sound the same off the digital output.

They think less than one percent of owners will use the digital output.

I look forward to the independent lab test reports.

Thanks MM!!!!

The reason I would like to leave Jeff from RA out of this, for the simple reason he was hired as a sub-contractor.
Olive media products, Is fully responsible for its products released in to the market place.
Jeff is not responsible for Olives Marketing antics. The Opus is a Modded Musica.
Olives site gives you a false impression that the unit is a OEM unit.
Many people I have talked to felt the same way.

I don't have a problem with the Opus being a modded Musica--I suspected this going in. My logic was that I could save time and preserve my warranty by purchasing a unit that was already "modded" by Olive. Knowing that Resolution Audio was involved further put my mind at ease.

Now I have an Opus that arrived yesterday, in which I don't know what to do with. I have not yet unpacked it...

It may have been an implied consent situation. For example, if you tell me we are being recorded and I don't object, that is implied consent. Nevertheless, 9 times out of 10 recorded telephone conversations are rarely used as evidence due to the high incidence of falsification (due to editing) and the difficulties with proof of integrity of the evidence.

NOW FOR THE BIGGEST LIE OF THE OPUS:

They Advertise the Opus having 4 (FOUR) Dacs.
WRONG! IT uses 1 (one) 2 channel DAC :o

This is the Reason they grinded the part numbers From the Chips on the Dac card.
It was to hide the big lie. :icon_twisted:

Another owner contacted me today, regarding his Opus he just received from a "Group Buy".
He is not happy at all with the sound of the OPUS.
To make matters worst, the Unit was purchased from a "Group buy" with the condition of NO REFUNDS, NO RETURNS. :x

It sounds like the supposedly great sounding Opus needs to be directly compared to one of the bogus units, or at a minimum open up the "good" one to see what's inside.  My guess is that neither of these will take place.  I'm lucky the price was still too high for me, because it sounded great on paper.  This whole thing smelled bad at the start of the thread and the stink seems to be spreading, although I guess there's some possibility that more than one quality of unit was built.

I would like to add I have no personal vendetta against any organizer of a group buy.
They where just a victim, of a companies marketing antics.
These organizers are an asset to the audio circle.
To offer the members of this "group" special offers, unlike any other audio forum known to date.
I trully enjoy this Forum. Its a group of very nice people who help each other.
I felt it was only right, for the members, to know the truth.

In the interest of two-sidedness, here's a verbatim copy of an e-mail exchange I had about this topic with someone else who was curious about the other side of this story:

"I did get to speak to both Robert of Olive and Jeff of Resolution Audio in regards to that posting on audiocircle by Anthony (MauiMods).  I got a different side of the story for them.  Apparently, Anthony was very pissed at Olive because John (VMPS) offered a "group buy" on the Opus at a price that was well below the MSRP.  Anthony was an Olive dealer and wanted to sell modded Opus units.  He had words with Olive, then they removed him from the dealer list and he flipped out.  This happened around the same time that he opened the Opus and discovered that it is a modded Musica/Symphony board... with the Resolution Audio DAC board.  According to Jeff, Anthony is not placing his GND of his scope probe in the correct location and as a result, is getting a poor looking signal.  He is supposedly also not using an active probe, so his probe is loading down the signal.  Anthony's "fix" is to replace an inductor with a short (between two ground planes), but Jeff said if he placed his probe's GND on the other  side of the inductor, he would see that same clean signal."

Perhaps we can give this thread a rest? There's a *real* war going on in the Middle East!

Mr 6 moons! :notworthy: Waz up!

This is exactly what I told John C tonight on the phone what they would say.
Did Jeff show you his bogus Scope shots he was going to use taken only 50 seconds apart?
Did Jeff and Robert explain the math, how they got 4 Dac's out of one 2 channel Dac?
Did Jeff Tell you he was hiding info from Robert, and did not want me to confront Robert with the findings?
Did Robert tell you he voided my warranty's on new units?

My "FIX" that you Claim is totally wrong.
Maybe you should of interviewed me to hear my side of the story, and I can show you the emails and evidence.

Quick question, is Olive a CUSTOMER of yours?
Do they ADVERTISE ON YOUR WEBSITE?
                         OR
Are you looking for Brownie Pionts, so they would?  aa

Why don't you give me a call?

SHOW ME A PURCHASE ORDER
SHOW ME A CANCELED CHECK
SHOW ME A PAYMENT I MADE TO OLIVE.
I NEVER BOUGHT ANY UNITS FROM OLIVE.
I BOUGHT THEM FROM A DEALER.

From the very beginning it was clear that Maui had an agenda involving the deal J Castler had set up. He repeatedly has been attacking the "group buy" and also his own loss on the several units he intended to sell. So now he has narrowed his smear from three parties to just Olive. Maybe if he had done that from the start he would be more credible...kinda shot himself in the foot
