I agree about the legality.  I alerted a few folks in the industry to these a few days ago.  It will be interesting to see what happens.  My $.02 is that there is NO way Alan has the rights to these, to be able to resell.  Personally I'm staying away.

Kind of Blue
This tread has recently come to my attention; apparently there is a tremendous amount of speculation about the intention of my CD up-sampled projects/collection? Why? The physical projects are not available to the general public for re-sale. My projects are not intended to be redistributed in any form considered illegal by the music industry. It is true that I considered the idea of offering a few of the up-sampled projects in the form of an uncompressed .flac file via a USB stick, but in light of recent events have opted to drop the idea. We will no longer be making any of our projects available to the general public.

I am currently located in Europe, and to my knowledge, at no time did I violate current US copyright law by up-sampling my personal CD collection for private use. I am also fairly confident that I did not break any laws offering the up-sampled computer files in the form of a USB stick. My knowledge of the RIAA copyright states that distribution is considered an internet download/upload from a pirate site, use of email, IM, illegal membership sites, etc. It is also considered an unaltered mirror to mirror hard copy in the form of a CD-R, mini disc, or DAT. Up-sampling material for private use is not a crime, and as the law is currently written, offering a computer file via a USB stick is also not a crime and does not require the user to purchase the rights to the material. On the other hand, if someone that has purchased the file from me decides to upload/re-sale the media then that is considered a crime.

With that said I find the above comment about Kind of Blue interesting.

"He sold a version of "Kind of Blue" apparently sourced from vinyl or some other not original digital source and then "cleaned up" using his proprietary methods. It wasn't well received in terms of SQ."

I ripped and up-sampled Kind of Blue 2 days ago, and besides myself no one has heard it. If you know otherwise please email this individual so I can address their untruth.

A little background on my current projects: None are sourced from vinyl. The older projects are EAC rip to an external up-sample capture. Now I use EAC to HD-Solo Ultra to up-sample. And BTW, at no time did I ever list my projects as sourced from the "Original Masters", that apparently is something you folks have manufactured over the past couple of days. Now I would appreciate that this non-sense comes to an end.

He's not allowed to sell it either.  He's breaking copyright laws in attempting to do so...

i'm not aware that he's addressed it much. any person with a facebook account can read his communications going back a few weeks, he posts often each day.

on the day this all broke he mentions a disgruntled previous customer was causing friction so he pulled the thumbdrives, but that was it. business as usual attitude.

i'm a first time customer, as of a month ago.  its time for a 2nd order & not having a central website is an issue, but not a deal breaker.
