Jail breaking is never ilegal is it?  Apple just does not want you to do it.

It's never illegal.  Apple will just void your warranty and "brick"  your phone if it is discovered.  Big brother is watching...

The main reason why Apple doesn't like jailbreaking is that it puts their DRM at a huge risk and would upset their content providers.

Apple will most likely respond by just disabling any DRM software/hardware on the phones permanently.    IMO, this is truly not a big deal if they did since one of the main reasons folks did this is to access additional content that either violated Apple's core values or run codecs that they don't support.   What would be more interesting if Apple allows users to restore the the original OS with DRM re-enabled... My guess would be no..
