Well, looks like I might wind up being the victim of a smear campaign.

I am going to lay out the basics of the whole story. So when the smear campaign starts you guys can know where it is coming from. I may have to seek some legal action or something, but at this point I am still trying to figure it out.

I bought a small electric car on Ebay from a dealer in Austin. I thought it would make a nice car for the wife and kids to run around town in. We live in a small town that doesn't even have a stop light in the whole town, so something like this is ideal. Here it is:

Funny thing was that the dealer would only take a wire transfer of the funds and despite being just 5 hours away he didn't want me coming to get it. I should have seen those red flags. I am too trusting of people.

Unfortunately the car was not as advertised.

Some of the problems included:

The hood does not open and hood release level has been broken off (not show in the pictures).
The front brakes are locked up (big problem!). This doesn't exactly make it "runs and drives great".
The CV joint boots are split with grease dripping out of them on both sides.
There is body damage and attempted repairs plus spray paint on nearly every panel.
The whole underside of the car has rust all over it.
Something is wrong with the front suspension and one side of the car is over 1" (nearly 1.5") lower then the other side. (see pic).
The seat covers don't match...

So I brought all of this to his attention and asked to be refunded as none of this was disclosed. Not surprisingly he refused. After repeated attempts he agreed to resale the car to someone else and pay me back. I agreed only if the next buyer was made aware of all the things that are wrong with the car before hand.

Then the dealer (Antonio Burnet) made arrangements with another dealer for purchase, but I had to trailer it all the way to Dallas to deliver it to him. Thinking this was the only way I was going to get reimbursed for the deal, I took it down there to a meeting place that Antonio set up. The other dealer had to drive in from Louisiana.

However, Antonio refused to show up for the meeting that he arranged. He said is was afraid there would be some controversy. :-) This left me with the new buyer and no title to have to work out a deal between the two of us and Antonio who we could only talk to via phone. I agreed to take some money from the new buyer on Antonio's behalf and the rest after he received the title from Antonio (that he refused to show up with).

In the end I was still $501 short of what I paid Antonio. That doesn't include the transportation cost of getting it to me or the cost of taking it to Dallas. He still refused to pay that balance. I did get my TT&L back from him at least.

Then he asked me to go onto Ebay and cancel the transaction as if it didn't happen. I actually agreed to do so if I was paid back in full. Only then would it be no transaction for me. He still refused to pay back the balance. So eventually I left feedback and it wasn't real good.

So today I get the treating e-mail from him:

Sounds like your business is very dependent on a good word and reputation in forums and internet costumers. Internet business its a bitch that way because you are completely dependent on a good word and customer feedbacks and reviews. It would be terrible and very costly for that to be tarnish with your business, name and reputation.

Ignore him.  He's lying about the transaction so he's probably lying about revenge, too. I doubt he even knows what circles you travel in.  I have been through some tough ebay situations (Anybody here from Calgary?  I can warn you about one!), and the worst thye will bother to do is badmouth you on ebay.

Given that his feedback is in the dumps, no one will take it seriously.

If he does leave bad FB (do they do that anymore?) you can contest it.

Sorry to hear that Danny.
My mother got scammed on a ebay/craigslist auto purchase. I felt terrible as I wasn't paying enough attention to what she was doing.

That's funny.

Yeah, a realized after the fact that the little car was not very well made. If the guy would have just been up front about the problems, then I would have no beef with him about it. For $3,000 or so I would have kept it and fixed it up. The seller was just unwilling to do anything.

I will report him to Ebay and will likely file a dealer complaint with the Texas Department of Motor Vehicles. That still may not keeping from posting bogus posts on the Internet though.

Then you can get him for libel.  Or slander.  I always get those mixed up.   :duh:

Either way, he's bluffing.

Threatening a buyer with negative feedback (or anything else) is directly against core ebay guidelines.  Contact ebay, copy them on the email and he will be banned.

One more thought...I believe that anyone threatening to do something unless you do something is guilt of extortion. Definately save those emails and contact the authorities

Yeah, PayPal is really good about taking care of fraudulent transactions.  I've only had two in ten years, but they've always taken care of me!

I had the opposite experience with my purchase on ebay motors.  I bought a car 4 years ago for well over $20,000 so I was quite nervous about the transaction.  I did a ton of digging to understand how the process worked, and what my courses of action I could take in the event of trouble.  The transaction was completely trouble free, the car was actually in better condition than the seller stated.  Its disheartening to see such a nice guy get the shaft by a scurrilous individual.  Ebay motors has buyer protection for up to $50,000 on most automotive transactions.  I'm not exactly sure how it will work out with the transaction being canceled, but there is a ton of helpful information here. http://pages.ebay.com/help/buy/ebaymotors-protection.html

I think your reputation will remain in tact.  Your give your time generously to this community, selling top quality products at a fair price, giving your customers the best bang for their buck, and you've won a ton of awards.  Most people can see right through a grammatically challenged idiot attempting a smear campaign.   Especially when going up against class act like yourself.  I know I speak for many people on Audio Circle, I'm a lifelong customer.  Keep making products on the same quality level you are now, and I will never buy another speaker from anybody else.  Period. 

The best revenge you can get against somebody like this is to keep doing what you are doing.
