Although I've never had the pleasure to meet your aquaintance, I'm still sick with the pain of what you are going through.  There's no sense to be made of such a senseless tragedy.  I hope the memories of your life with her and the impact she had on the lives she touched is a comfort to you in this dark time.

No one should have to go through this.  I can not even sit here and pretend to know even the slightest bit of sheer anger and pain I would be feeling in your situation.

It really makes me angry when I see stuff like this.  How the hell can a guy get arrested three times for DUI and still be out on the roads?

Good question Rob. In Oregon a second DUI is automatic jail time. Third time you're going to state prison. I didn't even know there were states that still allowed this behavior. It's extremely upsetting.

The judge should go to jail too.

Dear Chris,

                Although I don't know how it feels to lose a daughter, I lost my dad while he was recovering from a triple bypass surgery 11 years ago.  I was 14.  Sometimes, even time cannot totally undo the pain we feel, because we will always miss that special person in our lives.  I am truly sorry for your loss.  You will be in my prayers.

Man indicted on murder charge

ANGLETON — A 32-year-old man who had been convicted three times of driving while intoxicated has been indicted on a murder charge by a Brazoria County grand jury.

The indictment came Wednesday, about five weeks after the truck Elden Lee Carter of Angleton was driving May 13 struck a van, killing Jessica Engel-brecht, 32, of Houston, on the Highway 288-B overpass in Clute.

She died two days after the accident.

Police have said Carter, who was on probation for a DWI conviction, had a blood-alcohol level twice the legal limit, and beer cans were found in his vehicle.

Carter remained in the Brazoria County jail on the murder charge Wednesday. His bond was $1 million.

“Obviously, we intend to seek the maximum sentence,” Brazoria County District Attorney Jeri Yenne said. “He’s a danger to everyone who’s on the road. … He’s dangerous to the public at large.”

An indictment is not a finding a guilt but an indication that enough evidence exists to proceed to trial.

If found guilty, Carter faces up to life in prison and a $10,000 fine.

A court document shows Carter previously was convicted of driving while intoxicated in December 1996, January 2000 and March 2005. The document states the defendant “did commit an act or acts clearly dangerous to human life.”

Engelbrecht’s father, Chris Futrick, said he is thrilled the system might work this time, unlike before when he said, “the system totally broke down and let my daughter die.”

The day before the accident, Carter, who was being monitored by the probation department, appeared before District Judge Robert May after the state claimed he wasn’t living up to the terms of his sentence, including failing to complete a DWI Intervention Program.

Carter was screened for alcohol and drugs that day and tested positive for cocaine, officials have said. But he wasn’t arrested. Carter was supposed to report back to the judge May 19, and he intended to do another test.

“I’m very irate about what happened,” Futrick said. “He deserves to have his rear-end planted behind bars for the rest of his life.”

Futrick described his daughter as great and tremendous. He recalled how she constantly went out of her way for people, especially after Hurricane Katrina.

Engelbrecht and her husband filled a pickup with water and food, then gave it to evacuees who came to Houston, Futrick said.

She even helped care for one of the transplanted families, putting them up in a hotel room for at least a month, helping them find jobs and an apartment, he said.

But God wanted her, and it was her time to go to heaven, Futrick said.

Chris,

I just learned of your loss today.  My prayers go out to you and your family.  When I was in grade school I lost two friends due to a drunk driver.  IMO the US needs much tougher drunk driving laws.  IMO on the first offense a person's license should be suspended for life.  Period.

Chris, my heart goes out to you and yours.

It's so unfair your loving daughter is no longer with us, but she is in a far better place now with the Lord at her side. May she always be remembered for her kindness and how she always gave of herself. You should be very proud on how you raised her, and that she will never be forgotten.

The lawbooks need to be rewritten in this country, for far too many lawbreakers are loose on the streets. Unfortunantly, it's tragedies like this one that finally get the attention of lawmakers to do something about the system that fails innocent victims. Let's hope the right thing is done in this instance!

I will be in Huston Texas from the 18 to the 25  for the Recreation of the wreck it may take 2 days to do. The 3 top airbag experts in the U.S.  ------  Sal Fariello  will be there as the leading man  for the recreation , Chrysler  and the Feds N.t.S.B will also be there
On or about the 24th   the Judge will set the date for the Felony Murder Trial.

I will be heading back to Texas this coming week. All the replies and Emails I have received has helped  my heart and soul feel better.
All I can do with this tragedy is let Gods'  will be done,  not mine.
 
Everybody wants to be   FORGIVEN    but   no one wants to   FORGIVE. I have allready forgiven the man (in my heart) who killled my daughter.

I will let God take care of business with him

 I listen to  "The Divine Chaplet of Mercy".
 it's for everyone

As time passes a little bit of peace comes over me  but the  pain will remain forever

In english we over use the word "judgement" as it can to mean either discernment or condemnation or both.  This seems to confuse the thinking of most folks.  IMO our place is to discern and God's is to condemn.  I'm glad you've found some peace.  My son died 17 years ago at age 6 and I still can't laugh as hard as I once could.  My prayers continue for you and your family.

My thoughts go out to you. We just finished a two year suit representing a women whose son was killed by a druck driver. She was able to channel her energy over this to change the law in NY

Hang in there. Although it seems trite, time will help.

Hello Chris, I just came across this thread. For those who do not have children and even those of us who do, I am sure nobody can understand how such a tragedy effects you.

I am currently suing Chrysler because her air bags did not go off in her
brand new Town and  Country Van. If you know anyone who owns this van, tell
them they are driving a death trap and have the air bigs ckecked. There have been over 500 incidents of air bag failure with the town and Country mini van

Everyone most understand that I am not suing Chrysler for the $$$$. No amount of money can bring Jessica back to this Earth. Therefore there isn't any dollar amount of money to equal her life.
  I am suing Chrysler because Her Town and Country Mini Van had defective Airbags.and I want a recall of the 600,000 other Chrysler Vans or I will fight till I get it done
May my Daughter look down and  say
