This is realy a problem my pre-amp has to be set 10 positions higher then normal.

After I set the volume at "None",  the normal amount of sound is set to the pre-amp.
So this helps, but why can't I set it to the max when it is in software mode, and am I the only one?

I checked my BDP-3 and the max volume the slider shows is 3/4.

Does that mean it’s cutting off bits of data? Doesn’t full output give the full digital stream?

If you use a digital volume control you are reducing BIT's as you turn the volume down. 
Because more and more material is available in 24 or 32 BIT now its not as much an issue as it use to be.

This makes sense. Maybe the digital volume control was not meant to be a real "gain" or volume control but just as an accommodation in case you needed it. Otherwise, you get your optimum sound with the sound volume set to none and get the full output from the BDP3 through a pre-amp.

Till this update you could move it to far right. Do you have a BDP-3 then you should know.
This is also why I didn't understand your question about my pre-amp. There is still a dac between the BDP-3 and my pre-amp (a Esoteric C03xs), the DAC is a Bryston BDA-3.

Obviously, I was confused. I do own the BDP-3, but I have never used the volume control on it. Which update are you referring to? I still have the 2.42 update.
