Minor E-Bay Issue what would you do?

I bought a pair of Nordost Blue Heaven interconnects on EBay. They were advertised as new.

When they arrived the red band on one of the cables was cracked so it no longer stay on (think of a broken rubber band)

When I emailed the seller asking him if he had a replacement band he said no and reiterated "the cables are brand new I checked them out myself."

What would you do next?

I think your options are to ask for a refund or just let it go.  Not to mention the BS if you leave honest feedback.

Would a neutral rating highlighting the band problem be of any use to a future bidder and not create a huge amount of self grief?

I deal on ebay and always try to describe items to the "T"...Were the cables "NEW" and just the band broken? If so, I would leave positive feedback, but say : Item not as described" or something similar....If you contact Nordost they will repair cable at no charge...I bought a pair of speaker cables that were real bad and sent them back for a new pair at no charge...Always be extra careful when buying from Ebay...

What is the purpose of the band? Just to indicate polarity?  Is it possible the band was damaged in transit? If I believed that the band was broken from the start then I'd probably leave neutral feedback mentioning the item not described accurately. After all, if it was broken before the sale the guy LIED to you.

The purpose of the band is to indicate the left or right channel. There are red bands on both ends of one cable and black ends on both bands of the other.

I doubt it was broken in transit since it is just a band around the connector.

If it was a new unopened box it's possible it was broken unbeknownst to the seller. However the seller says "the cables are brand new I checked them out myself" which means he possibley opened the clamshell package in which case I think he should have noticed the broken band.

I'll call Nordost on Monday and see if they will send me a replacement band.  Based on the seller's response it appears he has no interest in assisting me.
