HELP... dealing with UPS over a damage claim

I am not having much luck with this bunch.  Any help with getting some attention over a claim for a damaged 626R.

Good luck. The only way I've had any luck dealing with VMPS is to keep hounding them. Even that doesn't work sometimes.

If you are the shipper, then it is your responsibility to fill out the mountain of paperwork and prove to UPS that the speakers were appropriately packed.

If this was a private sell from another VMPS owner, then they have full responsibility for dealing with UPS. In the eyes of UPS, you have no rights what-so-ever. Most people really don't want to go through the hassle so if you have the speakers you are more than likely out of luck. In this case it can sometimes be best to just ship the speakers back to the original seller and have them refund your money. They then have a strong incentive to deal with UPS and you are not out anything but your time.

If Brian sold you the speakers, then you just have to keep pinging him. Had you bought the speakers through me (the exclusive VMPS dealer for Texas), that would have been my responsibility and I could have lent you a pair while those were getting fixed.  :wink:

just to confirm- the shipper is UPS' customer-that is the ONLY person that they will deal with or (sometimes) even talk to- as a reciever you're not their customer and they couldn't care less about you

at least this was my experience after trying to settle a claim as a reciever

This is one of the issues one faces when buying used.  

I am glad to hear that you would go to bat for your customer.  If a dealer doesn't provide good customer service, there isn't any point in spending the extra money (dealer vs. used) buying from a dealer costs.

As others have stated, the sender will need to step up.  If the seller is an honorable person, they will refund your money and fight with UPS.  In the worst case, you might have to absorb some loss if UPS won't cover the damages (which they are notorious for).  I hope that the speakers were shipped in the original packaging.  Without that, there is very little chance of getting coverage.

This is for Big B.

All I've gotten from UPS is lip service with a promise to get the claim filed.
Problem is I CAN NOT file the claim, B needs to take control as he was the sender.  The container was double boxed w/top and bottom foam inserts.
UPS "The Shipper" is the party with whom I have issue ...  NOT VMPS.  Problem is I'm in a CATCH "22" situation at this point until BC makes a move.

Hi PC,

Generally what happens is you inform the shipper of the damage.  He/she informs UPS who then should either "pick up" the damaged property for inspection or do an "onsite" inspection to assess what happened.

UPS then will inform the shipper as to their position and will either pay, deny, or compromise depending on their assessment.

Do be aware that UPS might deliver packages promptly, but their feet do drag on payment, so the shipper might be waiting for response from them as to what they are going to do, to move forward.

They may ask the shipper (if they are the manufacturer) to repair or replace.

I sold a pair of Paradigm speakers to a guy in Little Chute Wi. They were insured. When they got there after he opened the cartons he found one speaker was slightly damaged. UPS sent an inspector out to look at the speaker. UPS then sent me the claims papers. I filled out my portion and sent them to the buyer so he could fill in the dollar amount of damage. What happened after that I don't know because I never heard from UPS or the buyer. I'm sure if there were problems someone would have let me know.
