Not Just Another UPS Story or is it???

Last August I send 4 pakages(speakers and stands) to a vacationing(in California for 6wks)Japanese fella from Tokyo.All pkages arrive safely from Ontario and all is well...NOT SO!!
6months later I get a bill for $235 because they sent the bill to the wrong address and I cannot possibly contact the buyer 6mths later..I phone UPS and they will take care of it ....well now I have a collection agency looking for the money....I phone UPS and they tell me it is taken care of....NOW today they say to bad pay us!!!!
When the triplicate forms were filled out BY ME,I stated buyer pays all boader costs and when the driver came with the stickers(way forms),he filled them out for my wife(I was away at work) and he put that shipper pays!!!
I had no idea what was happening here until I got the bill at Christmas and here we are...

DO I PAY or not? Am I in the wrong even though they sent the bill to the wrong place?
Do I send them 23 cheques for $10 each..I guess this grabs me the wrong way.

Can you prove that the recipient paid?

Well, you did write that buyer pays and the UPS guy did not see it and wrote shipper pays. I would scan that with an explanation and send it to UPS and the collection agency.

A friend works for a collection agency, and here's what I've been told about dealing with them in general -

Write a letter stating you dispute the charges and why.  I don't believe you need to provide proof at this point, but you need to officially dispute the charges.   If you don't do this, you legally agree that the debt is yours.  If the creditor (UPS, not the collection agency) wants further proof, they need to bring you to court.

Truth be known, do you think UPS will bring you to court for $250 or however much supposedly owe?   It'll cost them far more than you owe.  I'm not saying you owe them, but you know what I mean.

According to my friend, people owe companies thousands of dollars and get out of paying it.  The laws are stacked against the companies, not the people. 

I'm not saying your scamming anyone.

What you should immediately do is call the collections agency and tell them you dispute the charges.  They'll probably want an explanation and ask for some sort of proof.   They're not a court!   You can be nice and explain what's going on, but I'm pretty sure you don't need to.

Ask them how to go about disputing the charge legally.  Ask them the whole procedure.  The are legally required to let you know.  If they give you misinformation, they can be held liable.   Don't give them any money.  They may tell you to just pay it then try to get it back.

Once a debt is disputed, it can't go into your credit file until it's legally proven that you owe it.   Again, do you think UPS will take you to court for $250?

For the record...   I had a company who I know full well that I paid in cash at the time of service.  10 months later I was dealing with what you're dealing with.   If it weren't for my friend, I'd be out about $1000.

Actually i can tell you exactly what happened here. They dropped the stuff off at the front and left it on his porch without a sig. They didnt collect the money from the  guy and he is now (like yourself) refusing to pay. I don't blame him. What they do is they will come to you to collect since he isnt paying. Thats what they get for just leaving stuff on the doorstep...

I have never seen a ups way bill where its opted who pays border costs..

the worst part is I have used UPS for everything and the last shipment (5 pkgs at 110lbs each) ...I got anothe bill for $64 for some reason and the same girl who told me to pay started asking me to check my visa reciepts and find documents(on the last shipment,2wks ago) for her so she can see what the $64 was for???? I told her that if this billion dollar company cant find out that info on their own then they have real issues.I am done with UPS forever!!

That's not going to work.   They'll keep calling just to harrass you.  The guy I know is a friend's son.   He's a college student.  Most people he works with are too.   The names of the individuals are fake, as are most of their accents. 

They've been trained on how to dance around the truth.   They can't outright lie and give wrong legal information, but they can obscure the facts.  The company doesn't make money unless they collect.   

Most of the clowns who work collections actually have fun with it.  They love callng the rude people just to see what they'll do next.  Here's a great story:

My friend calls a guy who owes the cable company about $15k.  And they haven't disconnected the guy?   That's a lot of porn!    The guy always answers the phone.  He'll say he's John junior, and his father abondoned him. He'll say call me when you find him, cause he owes me child support.  Other times he'll say John died masterbating to all the porn he ordered.   He's said he went to the cable company's main office to pay in cash, but they didn't have change for a million dollar bill. 

He's got guys who yell and swear at him.  He'll call back every hour on the hour if he's in the mood.

Another guy was in collections after he stopped making payments for her breast implants because she left him.  He'd say some crazy stuff like rather I tried to return them, but the doctor won't take tham back; I'm not paying for something that I can't play with anymore, etc. 

When they call you, don't make it fun for them.   Just say you dispute the charge and ask how to go about it.   If they're being difficult, ask for a supervisor and keep him/her on track.  Tell them the only thing you need to know is the legal steps.  If they still dance around, threaten to call the consumer protection agency to ask them the legalities.

Don't do UPS's homework.   Make them figure it out.  Check your bills and cancel payment if there's something not right.   

Werd's probably right about them just leaving the package then trying to cover their mistake.

If it goes to collections, make sure you dispute it.

Iam surprised about UPS reputation, almost every one have a problem with ithey in the past.  The Fedex guys are celebrating with champagne, cheers...

Can you say for certain that the receiver did not pay this fee. I really think you should contact him or her and find out. Was this issue not stated to the buyer up front so that he knew what to expect and if so then they know if they paid or not.
Fed-Ex and UPS are going to merge and name the new company Fed-Up. Their motto will be "Your lucky the damn thing got here at all".

You have to be carefull with collection agencies. To my knowledge, the can start looking at and freezing your assets? A friend of mine owes a credit card company a few thousand dollars and it went to a collection agency. The agency now threatens her with taking her assets (car, etc). I don't know if this is true or just a scare tactic. Maybe if anyone here is a lawyer they can shed some light.
